Legal guidance and administrative support

Purchasing a property in Spain involves more than simply finding the right home. Various legal and administrative matters must be handled carefully and correctly, such as verifying ownership rights, drafting and reviewing contracts, and completing the final transfer before a notary.

For this reason, Nelemans has been working for many years with reputable Dutch and Spanish–Dutch-speaking law firms specialized in real estate transactions in Spain. These legal partners guide our clients throughout the entire purchase process and ensure that all documentation is properly reviewed and prepared in accordance with applicable regulations.

In addition, a gestor often plays an important role in Spain. A gestor is an administrative specialist who assists with practical and bureaucratic matters related to your purchase and stay in Spain, including:

  • Applying for an NIE number (tax identification number)
  • Handling tax-related matters
  • Assisting with administrative procedures with public authorities
  • Preparing documentation required for the purchase of your property
  • Supporting registrations, insurance, and utility connections

Through the close cooperation between lawyer, gestor, and notary, the entire process is carried out in a legally correct, transparent, and secure manner.

Nelemans purchase guidance – clear, professional and legally secured

When you appoint Nelemans as your buyer’s agent, we work on the basis of a clear and pre-defined service agreement. For our full support, expertise, market knowledge, and coordination throughout the entire purchase process, we charge a fee of 5% of the final purchase price, plus IVA (VAT), based on a “no cure, no pay” principle (no result, no fee).

This buyer’s agency fee is exclusively applicable to properties that do not form part of Nelemans’ own portfolio and that are offered through third parties, such as real estate agents, developers, or other providers.

For properties that are part of the Nelemans own portfolio, it is expressly stated that no buyer’s agency fee of 5% plus IVA (VAT) will be charged to the purchaser. In such cases, Nelemans acts as the selling party or commercial agent, and its remuneration is already included in the purchase price or otherwise agreed within the specific transaction.

What our service includes

This fee relates exclusively to the services provided by Nelemans as an independent buyer’s agent and includes, among other things:

  • Full end-to-end purchase guidance, including the involvement of a lawyer and/or gestor
  • Active property selection based on your requirements, through recognized API-affiliated agents
  • Negotiation and strategic pricing advice
  • Coordination with lawyer, gestor, notary, and selling parties
  • Guidance throughout the entire process, including aftersales
  • Access to our network and carefully selected projects and properties

Clarity towards third parties and partners

The 5% fee plus IVA (VAT) is a contractual agreement between Nelemans and its client (the buyer) and is entirely separate from any fees, commissions, or arrangements involving sellers, developers, agents, or other third parties.

This means specifically that:

  • Third parties have no right to claim, share in, offset against, or challenge this fee
  • The Nelemans fee is an independent, exclusive remuneration for representing the buyer
  • Any cooperation with external agents or developers is always agreed separately and transparently
  • There are no duplicate or conflicting fee structures

This provision applies expressly regardless of how the property was introduced to the buyer, including but not limited to listings or offers presented through third parties, collaborators, or external agents.

This working method is in line with applicable Spanish and European regulations and ensures a clear, transparent, and legally sound position for all parties involved.
