Purchase Representation and Fees
Nelemans Housing Solutions acts as an independent buyer’s agent representing the purchaser. For these services, Nelemans charges a fee of 5% of the final purchase price, plus IVA (VAT), as set out in a written service agreement with the client.
This fee is applied under the “no cure, no pay” principle, meaning that a fee is only payable upon the successful completion of a property purchase facilitated by Nelemans.
This buyer’s agency fee is exclusively applicable to properties that do not form part of Nelemans’ own portfolio and that are offered through third parties, such as real estate agents, developers, or other providers.
For properties that are part of the Nelemans own portfolio, it is expressly stated that no buyer’s agency fee of 5% plus IVA (VAT) will be charged to the purchaser. In such cases, Nelemans acts as the selling party or commercial agent, and its remuneration is already included in the purchase price or otherwise agreed within the specific transaction.
The fee constitutes a separate, independent, and exclusive remuneration for the services provided by Nelemans and is entirely independent of any commissions, fees, or arrangements involving sellers, developers, listing agents, or other third parties.
Third parties — including, but not limited to, selling agents, developers, or other property providers — shall have no right whatsoever, and expressly waive any claim, participation, set-off, or objection with respect to this fee of 5% plus IVA (VAT).
This provision applies regardless of how the property was introduced to the buyer, including but not limited to listings or offers presented through third parties, collaborators, or external agents.
Any cooperation with third parties shall be agreed separately and in writing and shall not affect the fee agreed between Nelemans and its client.
In all cases, the terms of the written service agreement between Nelemans and the client shall prevail.
Final Clause
